Agreement to proceed

Complete each certification below to proceed. The full JustHeat® Heat-as-a-Service Operating Solution Agreement can be read in full at any time.

Evaluation, Survey and Deposit

I understand and agree that:

  • This activation begins an evaluation of my property for the JustHeat® Heat-as-a-Service service, and is not itself the agreement under which the service is provided.
  • Following this activation, the Provider will undertake to carry out a full survey of the property, prepare an installation plan, and prepare and provide a quotation for the monthly JustHeat® Heat-as-a-Service Operating Solution Agreement under which the service would be provided.
  • I will engage reasonably and in good faith with the survey, assessment and planning process, including by providing safe and timely access to the property and any information reasonably required to assess suitability and design the installation.
  • The quotation for the Operating Solution Agreement will remain valid for 30 days from the date it is provided.
  • The service will only be activated if I enter into the Operating Solution Agreement. Entry into that agreement is a condition of the service being provided, and until it is signed no service is provided.
  • A deposit of £200 (including VAT) is payable on activation. This deposit is refundable in full only if the Provider determines that it is unable to offer the service at the property, or the Provider’s survey concludes that no viable EPC improvement is achievable at the property. Any refund due will be made to the original payment method within 14 days of that determination.
  • Where the service can be offered, the deposit is non-refundable and will be credited against the amounts first due under the Operating Solution Agreement. In particular, the deposit is not refundable if I decline, or fail to proceed with, an offer that the Provider is able to make.
  • If I fail to provide reasonable access, or to engage with the survey and planning process within a reasonable period, the Provider may treat the activation as withdrawn and retain the deposit.
Property and Authority Certification

I certify that:

  • I am acting in the course of a business and not as a consumer, as or on behalf of a limited company that owns or lets the selected property, and the property is held for letting or other business purposes.
  • The property address selected and submitted through this platform is true, accurate and complete to the best of my knowledge.
  • I am the legal owner, landlord, managing agent or duly authorised representative of the owner or landlord of the selected property, and I have full authority to activate the service in respect of that property.
  • I have obtained, or will obtain, all necessary consents, approvals and authorisations required from any relevant owner, landlord, managing agent, tenant, occupier, lender, freeholder, superior landlord or other third party in connection with the activation and operation of the service.
Data, EPC and Environmental Rights Certification

I certify that:

  • I understand that the service involves remote monitoring, operational management, comfort optimisation, smart control support, EPC support and related data processing in respect of the Heating System installed at the selected property.
  • I authorise the Provider to collect, process and use operational, technical, environmental and property-related data generated by or relating to the Heating System, the Control Platform and the selected property for the purposes of operating, optimising and supporting the service.
  • I understand that such data may be used for monitoring, optimisation, maintenance, EPC support, MEES support, carbon accounting, environmental reporting, operational improvement and service administration.
  • I acknowledge that personal data will be processed in accordance with the Provider’s privacy policy and applicable data protection law (UK GDPR and the Data Protection Act 2018).
  • To the extent permitted by law, I acknowledge and agree that any environmental attributes, emissions reductions, carbon benefits, efficiency credits or similar rights arising specifically from the operation and optimisation of the Heating System by the Provider as part of the JustHeat® HaaS service shall vest in and belong to the Provider.
  • I confirm that I will not make any conflicting claim, registration, sale, transfer or assertion of ownership in respect of such environmental attributes, emissions reductions, carbon benefits, efficiency credits or similar rights.
  • I understand that the service is intended to support comfort optimisation, energy efficiency, EPC and MEES compliance activities, but does not guarantee any specific EPC rating, MEES outcome, energy saving, cost saving, comfort level or regulatory result.
Information Accuracy and Continuing Obligation

I certify that:

  • All information provided through this platform is true, accurate and complete in all material respects and is not misleading.
  • I will promptly notify the Provider if any information becomes inaccurate, incomplete or misleading, including any change in ownership, connectivity, Heating System status or authority to contract.
  • I understand that inaccurate, incomplete or misleading information may result in suspension of the service, cancellation of activation, withdrawal of EPC-related support or reassessment of any Heat-as-a-Service documentation relating to the property.
Electronic Signature and Agreement

I certify that:

  • By selecting the confirmation box below and submitting this activation, I intend to sign and be legally bound by these certifications as if executed in writing.
  • I agree that this electronic acceptance constitutes a valid and binding signature for the purposes of applicable law, including the Electronic Communications Act 2000 and any equivalent legislation in relevant jurisdictions.
  • I understand that, if I enter into the Operating Solution Agreement, that agreement will set out the full terms of the service and will supersede these evaluation certifications in respect of the provision of the service.
  • These certifications and any non-contractual obligations arising from them shall be governed by and construed in accordance with the laws of England and Wales.
